This Legal Disclaimer ("Disclaimer") sets forth the general guidelines, disclosures, conditions of use, and liability limitations governing your access to and use of the cluelabs.com website, Content Studio, conversational AI interactions, cloud data widgets, Model Context Protocol (MCP) endpoints, application programming interfaces (APIs), and all associated tools and software (collectively, the "Platform" or "Services") operated by eLearning Company, Inc. ("eLearning Company", "Cluelabs", "we", "us", or "our"), a New York corporation.
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Disclaimer, our Terms of Service, and our Privacy Policy. If you do not agree with any portion of this Disclaimer, you must not access or use the Platform.
Educational Information
2. General Informational and Educational Purpose Disclaimer
All content, tutorials, instructional design articles, community discussions, sample storyboards, course templates, prompt examples, and technical guides published on the Platform are provided solely for general educational, instructional design, and informational purposes. Nothing contained on the Platform constitutes formal legal, medical, regulatory, financial, accounting, or professional engineering advice.
While we strive to provide accurate, up-to-date, and authoritative instructional design resources, eLearning Company, Inc. makes no representation or warranty of any kind, express or implied, regarding the completeness, accuracy, adequacy, reliability, or suitability of the information provided on the Platform. You should not act or refrain from acting based on any content found on the Platform without seeking independent professional counsel appropriate to your specific operational, legal, or regulatory circumstances.
Artificial Intelligence
3. Artificial Intelligence and Automated Output Disclaimer
The Platform integrates cutting-edge generative artificial intelligence, large language models (LLMs), neural text-to-speech synthesis engines, and probabilistic media generators. These systems assist course creators by drafting course outlines, generating narration scripts, synthesizing voiceover audio, creating timed closed captions (SRT/VTT), generating illustrations and graphics, producing sound effects, and powering conversational role-play scenarios.
You explicitly acknowledge and agree to the following limitations regarding artificial intelligence:
- Probabilistic and Non-Deterministic Outputs: Generative artificial intelligence operates through statistical probability models rather than deterministic logic. Consequently, the Platform cannot and does not guarantee that any AI-generated outline, slide text, script, translation, quiz question, automated rubric evaluation, or media asset will be accurate, comprehensive, factually correct, pedagogically sound, or free from error, hallucination, or omission.
- Potential for Hallucinations and Inaccuracies: Machine learning models may occasionally produce plausible-sounding statements that are factually inaccurate, incomplete, misleading, or entirely fabricated ("hallucinations"). AI models may also reflect unconscious biases present in training corpora.
- Mandatory Human-in-the-Loop Review: You are solely and exclusively responsible for the editorial review, factual verification, pedagogical validation, and approval of all AI-generated content before incorporating such content into courseware or publishing it to learners, employees, clients, or the public. You must never deploy unverified, raw AI outputs in mission-critical, regulated, or high-stakes training environments.
- High-Risk Subject Areas: Where training content pertains to clinical healthcare, medical procedures, pharmacology, occupational health and safety (OSHA), aviation, structural engineering, hazardous materials handling, law enforcement, or statutory compliance, all AI-assisted materials must be rigorously inspected and certified by qualified, credentialed human subject-matter experts (SMEs) prior to deployment.
- No Liability for AI Reliance: To the maximum extent permitted by applicable law, eLearning Company, Inc. expressly disclaims any and all liability for direct, indirect, incidental, consequential, or punitive damages, workplace incidents, regulatory sanctions, or legal liabilities arising from your reliance on, or your learners' exposure to, unverified, inaccurate, or biased AI-generated content.
Third-Party Integrations
4. Third-Party Software and Trademark Disclaimer
Independent Platform Status
The Cluelabs Platform is an independent software and cloud services platform engineered by eLearning Company, Inc. to augment standard elearning authoring workflows. References on the Platform to third-party software, applications, or companies—including but not limited to:
- Articulate Storyline®, Articulate Rise®, and Articulate 360® (trademarks of Articulate Global, LLC);
- Adobe Captivate® (trademark of Adobe Inc.);
- Lectora® (trademark of ELB Learning);
- Google Sheets™ and Google Cloud™ (trademarks of Google LLC);
- Microsoft Word® and Microsoft Office® (trademarks of Microsoft Corporation);
- Standard learning management systems (e.g., Moodle, Canvas, Blackboard, Cornerstone OnDemand);
are made strictly for nominative, descriptive, and identification purposes to inform users of the third-party platforms with which Cluelabs tools and widgets are compatible.
eLearning Company, Inc. and Cluelabs are not affiliated with, sponsored by, authorized by, associated with, or endorsed by Articulate Global, LLC, Adobe Inc., Google LLC, or any other third-party software manufacturer or trademark holder mentioned on the Platform.
Compatibility and Environmental Updates
While Cluelabs widgets and cloud endpoints are designed to operate cleanly within standard web browsers and authoring tool web objects, we do not control the software development cycles, security patches, browser sandbox restrictions, or operating system environments of third-party vendors.
We make no warranty or guarantee that Cluelabs widgets, embeds, or API connections will remain compatible with future updates, major version releases, or security policy changes implemented by third-party authoring tool vendors, LMS providers, or web browser developers (such as Chromium, Safari, Firefox, or Edge). We are not responsible for any functional disruptions, script blocking, or rendering anomalies resulting from third-party software modifications, corporate network firewall rules, or restrictive iframe sandbox policies.
Instructional Efficacy
5. Learning Outcomes and Educational Results Disclaimer
Cluelabs provides specialized authoring enablement, automated media synthesis, cloud data persistence, and behavioral analytics infrastructure. We do not provide instructional outcome guarantees or educational certifications.
We make no representations, warranties, or guarantees regarding:
- Specific learning outcomes, knowledge retention, or skill mastery achieved by learners who complete courses built using our tools;
- Learner completion rates, assessment pass rates, or certification exam performance;
- The pedagogical effectiveness or instructional superiority of any particular course outline, interaction model, or storyboard generated on the Platform; or
- Any commercial return on investment (ROI), sales growth, or operational productivity improvements realized by your organization.
Educational success depends on numerous pedagogical and organizational variables beyond the scope of our software, including instructional design strategy, subject-matter expertise, learner prerequisite knowledge, organizational support, and instructional delivery methods.
Accessibility Standards
6. Accessibility and Compliance Disclaimer
Cluelabs provides powerful authoring tools engineered to support inclusive course design, including automated closed caption generation (SRT/VTT), neural text-to-speech audio narration, high-contrast visual styling presets, and structured semantic document exports.
However, the availability or use of these features does not automatically ensure that your published courseware, website, or training modules will fully comply with applicable accessibility standards, including:
- The Web Content Accessibility Guidelines (WCAG 2.1 / 2.2 Level AA or AAA);
- Section 508 of the United States Rehabilitation Act of 1973 (29 U.S.C. § 794d);
- The Americans with Disabilities Act (ADA); or
- Equivalent international digital accessibility statutes (such as the European Accessibility Act).
Achieving full accessibility compliance requires holistic course-level design decisions, including proper color contrast selection, keyboard navigation sequencing, comprehensive screen-reader testing, manual verification of automated caption accuracy, and the provision of descriptive alternative text for all non-text elements. You remain solely responsible for auditing, testing, and ensuring that all training deliverables created with the assistance of Cluelabs meet the statutory accessibility standards governing your organization.
Infrastructure & Uptime
7. Cloud Infrastructure and External API Availability
Certain advanced capabilities on the Platform rely on external cloud service providers, network telecommunications backbones, and third-party foundation model APIs (including Google Cloud Platform, OpenAI, ElevenLabs, Amazon Web Services, and Stripe).
While we implement multi-region infrastructure and redundancy across certified global data centers, we do not guarantee uninterrupted, instantaneous, or continuous availability of any cloud service. eLearning Company, Inc. is not liable for service latency, API throttling, cloud hosting outages, scheduled vendor maintenance, or telecommunications disruptions originating from external upstream service providers or public internet routing failures.
Commercial Integrity
8. No Commercial Sponsorship or Affiliate Compensation
Cluelabs operates strictly as a subscription-based, business-to-business (B2B) software-as-a-service (SaaS) authoring and data platform.
- No Paid Advertising: We do not accept paid commercial advertising, sponsored reviews, promotional product placement, or third-party marketing advertorials on the Platform.
- No Affiliate Commissions: We do not receive affiliate commissions, referral fees, or financial kickbacks for linking to or referencing external authoring tools, software platforms, or third-party service providers.
- Independent Recommendations: Any reviews, workflow tutorials, or tool comparisons published on our blog or documentation reflect the genuine professional judgment of our instructional design team and are never influenced by commercial advertising compensation.
End-User Responsibility
9. Customer Responsibility for End-User Deployment
When you deploy courses, widgets, or tracking scripts that interact with your learners, employees, or clients, you are solely responsible for:
- Ensuring that your deployment complies with all applicable privacy, consumer protection, and data privacy regulations (including GDPR, CCPA, and COPPA);
- Providing clear, accessible notices to your learners regarding the collection, storage, and processing of their learning data, quiz scores, and interaction statements;
- Securing all required consents from learners prior to capturing their input or recording their voice in conversational AI scenarios; and
- Maintaining the security and confidentiality of your course variables and database credentials.
eLearning Company, Inc. is not responsible or liable for any disputes, regulatory complaints, or legal actions arising between you and your learners, clients, or end-users.

10. Modifications and Updates
We reserve the right to revise, amend, or update this Legal Disclaimer at any time in our sole discretion. When changes are made, we will update the "Last Updated" date at the top of this page and post the revised version on the Platform. Your continued access to or use of the Platform after the effective date of the updated Disclaimer constitutes your binding acceptance of the modified terms.
